{"id":14020,"date":"2026-05-01T12:31:16","date_gmt":"2026-05-01T07:01:16","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=14020"},"modified":"2026-05-01T14:30:53","modified_gmt":"2026-05-01T09:00:53","slug":"national-company-law-tribunal","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/national-company-law-tribunal\/","title":{"rendered":"National Company Law Tribunal"},"content":{"rendered":"<h2><b>National Company Law Tribunal Latest News<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Recently, the Supreme Court has taken suo motu cognisance of delays by National Company Law Tribunal (NCLT) benches in approving resolution plans under the Insolvency and Bankruptcy Code (IBC).<\/span><\/p>\n<h2><b>About National Company Law Tribunal<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is a <\/span><b>quasi-judicial authority<\/b><span style=\"font-weight: 400;\"> incorporated for dealing with corporate disputes that are of civil nature arising under the Companies Act,2013.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It was constituted on 1 June 2016 <\/span><b>under the Companies Act, 2013.<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">It was established based on the recommendation of the <\/span><b>Balakrishna Eradi committee<\/b><span style=\"font-weight: 400;\"> on law relating to the insolvency and the winding up of companies.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Composition:<\/b><span style=\"font-weight: 400;\"> It shall consist of a President and such number of Judicial and Technical Members as may be required.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Appeal:<\/b><span style=\"font-weight: 400;\"> Decisions of the tribunal may be <\/span><b>appealed to the National Company Law Appellate Tribunal<\/b><span style=\"font-weight: 400;\">, the decisions of which may further be appealed to <\/span><b>the Supreme Court of India<\/b><span style=\"font-weight: 400;\"> on a point of law.<\/span><\/li>\n<\/ul>\n<h2><b>Powers of National Company Law Tribunal<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It <\/span><b>is guided<\/b><span style=\"font-weight: 400;\"> by the <\/span><b>principles of natural justice,<\/b><span style=\"font-weight: 400;\"> subject to the other provisions of this Act and of any rules that are made by the Central Government.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It can enforce any order that it gives in the same manner as a court would enforce it.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It has the power to <\/span><b>scrutinize its own orders.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It has the power to <\/span><b>regulate their own procedure.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is the <\/span><b>adjudicating authority<\/b><span style=\"font-weight: 400;\"> for the <\/span><b>insolvency resolution<\/b><span style=\"font-weight: 400;\"> process of companies and <\/span><b>limited liability partnerships<\/b><span style=\"font-weight: 400;\"> under the <\/span><b>Insolvency and Bankruptcy Code, 2016<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<p><b>Source: <\/b><strong><a href=\"https:\/\/www.newindianexpress.com\/nation\/2026\/Apr\/30\/sc-takes-suo-motu-cognisance-of-nclt-delays-in-approving-resolution-plans-flags-grim-situation\" target=\"_blank\" rel=\"nofollow noopener\">NIE<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>National Company Law Tribunal is a quasi-judicial authority incorporated for dealing with corporate disputes that are of civil nature arising under the Companies Act,2013.
